Welcome, introductions, and review agenda

Lynita Docken welcomed everyone to the July 28, 2010, meeting of the Pool Advisory Code Council. After Council members, department staff and guests introduced themselves, the meeting’s agenda was reviewed and accepted without changes.

Explanation of known Virginia Graeme Baker Act (VGBA) issues and Consumer Product Safety Commission (CPSC) interpretations that may impact the Wisconsin Public Swimming Pool Code, Chapter Comm 90

In a PowerPoint presentation, Lynita compared the Virginia Graeme Baker Act (VGBA) and the Consumer Product Safety Commission’s (CPSC) interpretations of the VGBA to the Wisconsin Public Swimming Pool code, chapter Comm 90. She pointed out that the VGBA has created much stir and confusion throughout the United States. Wisconsin has responded with an alternate VGBA pool approval to give existing pool and water attraction businesses a broad spectrum of solutions for compliance with VGBA. Wisconsin’s alternate has saved pool owners thousands of dollars.

When looking at the levels of protection, staff developed a list of issues:
  • Features – Comm 90 does not address specifically; VGBA does include.
  • Suction outlets – Comm 90 does not allow protrusions that create a safety hazard; VGBA allows grates and sumps to protrude into the basin up to 2 inches.
  • Suction Vacuum Release System (SVRS) – Comm 90 does not allow SVRS in shallow water like wading pools; VGBA does allow.
  • Tripping hazard – Comm 90 requires a maximum of ½inch in shallow water (less than 32 inches); VGBA does not address the tripping hazard.
  • Equalizers – Comm 90 requires an equalizer if there is a skimmer (as required in the NSF 50 standard); VGBA requires grates for equalizers.
  • Circulation flow – Comm 90 specifies circulation flow in the pump design; VGBA uses pump maximum flow.
  • Main drain measurement – Comm 90 uses 36 inches from edge to pipe of main drain; VGBA specifies 36 inches from center to center.
  • Flow rate – Comm 90 allows both a blocked and an unblocked flow rate; VGBA wants the flow rate blocked.
  • Velocity – Comm 90 has a 1.5 ft/sec velocity; VGBA allows the manufacturer’s rated velocity.
  • Grate size – Comm 90 requires a 36-inch single grate; VGBA requires an 18 x 23-inch blocking element.
In addition, staff listed the following questions that need clarification:
  • Are hydrostatic relief limitations needed?
  • Should flowmeters be permitted to determine flow?
  • Maintenance drain (only) requirements?
  • Are main drains really necessary?
Public comment period on VGBA, CPSC interpretations and the impact on Wisconsin Public Swimming Pool Code, Chapter Comm 90

The public was invited to comment on the VGBA or other public swimming pool issues during the public comment period.

Trisha Pugel, representing the Wisconsin Hotel and Lodging Association – A lot of members of the Wisconsin Hotel and Lodging Association were impacted by the VGBA. On behalf of the association, Trisha listed the group’s main concerns:
  • When decisions are made or rules changed, these decisions and changes should be based on hard data.
  • It might be easier, but does it really make sense to align Comm 90 with the VGBA and CPSC?
  • Clarify what is a “small lodging property” which is exempt from the VGBA. (For example, no more than 5 rooms or units and the owner resides on the property.)
  • Is Wisconsin following the CPSC ruling on single drains?
  • How much is too much when it comes to “backups” and safety factors? Talking about minute data. There has not been a single case documented in Wisconsin. Making the VGBA changes during a recession has been devastating. A record number of members have closed their properties this year.
Peter Simon, Neuman Pools, Inc. – Peter discussed his concerns with the VGBA/federal requirements and with the 2009 version of Comm 90. He asked the Council to open up the code to address the VGBA and other issues.

Summarize comments and concerns

During the ensuing discussion, the Council recommended the following:
  • Features – Require circulation requirements apply to feature piping and outlets as well as circulation system suction outlets.
  • Suction Vacuum Release System (SVRS) – Continue interpretation to prohibit SVRS in shallow water in modified pools and new construction.
  • Equalizers – Allow installation of skimmers without equalizers in new construction.
  • Circulation flow – Use the VGBA recommendation of pump maximum flow.
  • Main drain measurement – Use the VGBA requirement of 36 inches from center to center because it is less restrictive.
  • Flow rate – Use the VGBA blocked flow rate.
  • Velocity – Allow the VGBA’s manufacturer’s rated velocity.
  • Grate size – Use the VGBA’s recommended size of 18 x 23-inch blocking element.
The consensus of the Council was to review all issues related to VGBA in future code development.

Discuss Comm 90 direction relating to submerged suction outlets

The Council discussed the following:
  • Open up the code and revise as needed.
  • Define the difference between a blockable and unblockable drain.
  • Differentiate between a manufactured or field-fabricated unblockable grate.
  • Keep eye on the development of DHS 172, the Department of Health Service’s model aquatic health code, which is closely connected to Comm 90.
  • Clarify the CPSC’s interpretations of the VGBA and have a united front in Wisconsin.
Other issues

Other areas of concern that the Council listed included Aegis grates from Neptune-Benson and Baja Pools.
Jim Miller announced that the department is sending a mailing to remind public pool and water attractions owners that they must be in compliance with VGBA.

Welcome and Introductions: Doug Voegeli called the meeting to order at 9:15am, and welcomed council members and guests. 

Period of public comment: There were no members of the public wishing to comment at this meeting.

Commerce Update
Talked about Administrative Forfeiture and explained the process of how it will work.  It was discussed that the definition of plumbing has not changed, so the committee was informed that if they have contractors who install plumbing and do not have a license, they may be subject to the forfeiture.

Review proposed revisions to Comm 90, Wis. Adm. Code
It was decided to look at what major items council members had, and if there are minor problems such as typos, memebrs can just give S&B staff their information and the changes will be made. 

Each member listed their major concerns.  The list was compiled and discussed one by one.

Will not address the certified pool contractor now, as it will be addressed when Comm 5 is updated. 

- Page 18, diving wells.  Extended board length to help clarify the “B” dimension.
- Page 28, Turnover times.  Peter questioned why a turnover is at 30 minutes for a wading pool.  It was suggested that it should be mandatory to use methods to eliminate crypto when water is sprayed onto the users.  There was discussion on water treatment and filtration.
- Turnover for swimming/diving was changed to 6 hours.  Discussion on turnover for activity pools.  Will work with health to make sure the two codes match with each other. 
- Page 42, obstructions, will add language on the size of an obstruction within the pool.  Changed language on where a spray feature can be located on a deck. 
- Page 47, Hand Rails, discussion on when a platform, slide, play feature needs to conform to Comm 62.
- Page ?, Discussion on allowance of a wall 18” around a whirlpool.  Should it be allowed? 
- Page 19, Bulkheads can only be in competition pools.  Question was what “supervision” is.  Change it to life guard staffing plan.  Also, take the words competition out.
- Page 36, What is “well ventilated”?  The building code states that is there is a problem, they need to take care of the problem.  Peter stated that inspectors have written him up on pools and they have not been uniform in the application of the definition.
- Page 37, Chemical feed pump language.  The chemical controller must have its own flow sensing device.  Language was added to address this issue. 
- Page 39, emergency stop buttons.  Added that water slides must also have the stop button easily accessible to the attendant or guard. 
- Discussion on runout slides and how they should be designed.  Chuck will get back to us with some wording on how slides should be designed. 
- Page 3, discussion of interactive play attraction.  Definition was changed to say that you can use up to 50,000 gallons per day of fresh water and not be considered a splash pad per Comm 90.
 After that amount, they need to provide filtration, plan review, etc. 
- Page 13, (e), Peter asked that any corrections needed must be done in writing.
- Page 16, Asked that all skimmer levels be at the same point.
- Page 19, #3.  Discussion on how the radius is interpreted. 
- Page 20, item e.  discussion on catch area.

1.  Welcome, Introductions and Announcements:  Meeting was called to order at 9:15 a.m. by Doug Voegeli, chair.
2.  Public Input: 
- Rick Meissner presented information on his climbing wall he’s developing.  Bill Rollins recommended that padding be required for climbing walls that is similar to pad walks.  The distance between two climbing walls be 15 feet, as required for diving boards was also discussed. 
- Jim Schwingle asked about the requirement for stairs on play features.  Docken suggested that he bring the issue up during the play feature discussion.
3.  Commerce Update: 
- Tim Joyce presented the checklist that inspection staff are considering for addition to the compliance statement.  Peter Simon made the motion that the department hold up on adding this requirement until after the code discussions and the new code is effective.  It was seconded and discussion followed.  No formal request was constructed by the council.
- Peter Simon also brought up the concept of the licensing of contractors in order to hold those contractors responsible for the installation of the designed plan.  Lynita Docken will talk with the Bureau Director of Program Development and report back to the council on this possibility.
4.  Code Draft Review: 
- Code draft discussion began on page 30 of the draft.
- Discussion of spray feature water being supplied from wading pools or whirlpools.  New York requires that all spray activities be pre-treated with UV.  Dave Pluymers will research this and return with a DHFS recommendation.
- The council discussed the equipment room and whether there’s a way to ensure accessibility and recommended an additional requirement that the equipment room be sized adequately for accessibility for maintenance.
- Sizing sanitizing equipment and the requirements for controllers was discussed.  Melanie Novinska said the Wisconsin Innkeepers Association (WIA) may have reservations about requiring controllers for all pools, regardless of size.  Jim Schwingle said even small pools require controllers.  Melanie will check with WIA and report back to the council.  Jim S. willl bring his calculation for chlorine requirements and more discussion will be planned for day two of this meeting.
- Tom Carrico reported his findings on diving boards.  Dean Mueller is going to work on concepts and will return with ideas for the code draft.  It was concluded that there’s no more spring or push off the board, so the “B” dimension may start at the end of the board.  The plummet must begin at or be less than the board overhang.

Day 2, September 19, 2007
(Code Draft Review, Cont.)
- At 9:15, Tom Carrico presided over the meeting in the Doug Voegeli’s absence.
- Discussion on gates, fences and barriers.  The code language was revised to reflect the discussion.
- Dan Joyce, PE from the DNR attended the meeting to discuss the WPDES General Permit for Swimming Pools.  The General Permit expired in March of 2006 and needs revision.  Dan drafted the last version, but it hasn’t changed much since he’s worked on it.  The current performance standards in the permit are:

Total Residual Chlorine - < .037 mg/L
pH – 6 to 9
Dissolved Oxygen - > 6 Cold water streams and > 5 non-cold streams
TSS – 40 mg/L

- Carrico asked how to find out about whether a project is good to go.  DNr would prefer that backwash be discharged to sanitary sewer, not grade or storm sewer.  DO isn’t required to be monitored unless the owner dechlorinates.  DNR would also prefer water to sit prior to being discharged.  Information is on the DNR watershed management website.  Dave Pluymers said that DHFS will work with DNR to provide information to owners.  He also talked about a “self-certifying” system for the pool designs.  Perhaps the Plumbing Code could require discharge of all backwash to sanitary sewer on municipal discharge systems.  Docken brought up that DNR could meet with the code council at another time to help develop the next General Permit.  Dan will contact the committee for input.
- Emergency stops were discussed and the number required for leisure rivers and vortex pools.  The draft was revised to reflect the discussion.
- More discussion on chlorine feeders and sizing.
- Bill Rollins brought up the splash pads and water waste issue with non-flow through pads.  Municipalities are tearing out wading pools and replacing them with the flow through devices that can use 500,000 gallons per day in a typical pad used 4 hours per day.
- Whirlpools, wading pools and interactive play attractions were discussed.  The draft discussion was completed and the plan for next meeting is to address the issues list and any remaining questions from this meeting.
6.  Next Meeting, Agenda and Assignments:  The next meeting is scheduled for Tuesday,. October 30th.  Meeting location will be the AmericInn Hotel in Wis. Dells.  Time is 9 a.m. until 3 p.m..

A video and poster are available.  Ryan Boebel has been hired as a Plumbing Consultant.  He will work out of the La Crosse office.
5.  Code Draft Review:  The primary focus for this meeting was the continuation of review of the Comm 90 Code draft.  Discussion included definitions and technical specifications related to swimouts and benches, diving wells, usable deck space and turnover times for circulation systems.  The review of the first draft of the code will be completed at the next meeting.

4.  Commerce - Agency Update:  Docken provided the Commerce update.  The update consisted of an explanation of how the agency handles designs that include run out slides versus plunge pools.  Issues include definitions, petition requests and handling design submittals as alternate product approval requests or experiments.

5.  Code Draft Review:  The primary focus for this meeting was Indoor Air Quality.  Additional discussion included inconsistencies between ANSI-IAF-1 and Comm 90 as it relates to diving wells.  The council members also discussed what standards should apply to pools.  Potential uses of a pool affect which standard applies.  Council members recommended that the HVAC council research guidelines or standards for pool related air handling.

2.  Public Input:  The Ecolab representatives and council members discussed electrical issues associated with flow switches. 

3.  Meeting summary for 09-13-06 meeting approved.

4.  Commerce - Agency Update:  Docken provided the Commerce update.  There are three options for a new code.
    a.  Adopt national standards with references.
    b.  Construct and enrolled code.
    c.  Construct a completely new WI Code based on national standards.

The council members recommended that the code work product consist of one document – an enrolled code that addresses standards ANSI-IAF-1 and ANSI-IAF-9.

5.  Code Draft Review:  The council continued discussion of the Comm 90 code draft beginning with ANSI-IAF-9 standard 17.2.5 Showers.  Discussion of assignments from last meeting was postponed.  No additional assignments were made.

6.  Next Meeting, Agenda and Assignments:  The next meeting is scheduled for January 10, 2007.  (Future meeting date – March 14, 2007.)  Meeting location will be determined subject to room availability.  Agenda will include further review of code draft and report out of postponed assignments.

1.  Welcome, Introductions and Announcements:  Meeting was called to order at 9:10 a.m.  Docken announced that Simon has scheduling conflict today and on November meeting date.
2.  Public Input:  None was given.
3.  Meeting Summary for 07-11-12-06:  Approved with minor revisions.
4.  Commerce - Agency Update:  Docken provided the Commerce update.  Robert DuPont, Bureau Director recommends the council consider adopting the IAF-9 standard with “Wisconsinisms” rather than develop separate Wisconsin code.  (Council members present agreed with this concept.)
5.  Code Draft Review:  The IAF-9 standard and Comm 90 code draft were reviewed.  Review of research that was assigned during the previous council meeting was postponed until a future council meeting.  Additional assignments were made:  Rollins is to take measurements of various “hopper” type pools so that a uniform methodology for measuring depths can be established; O’Conner is to check on availability of vertical wall signage; Docken is to determine whether ADA requirements must be addressed when Commerce codes are revised.   
6.  Next Meeting, Agenda and Assignments:  The next meeting is scheduled for November 29, 2006.  Meeting location will be determined subject to room availability.  Agenda will include further review of code draft and report out of assignments.   Additional-new assignments are listed in item #5 above.
7.  Adjournment:  The meeting adjourned at 2:45 p.m.

1. Welcome, Introductions and Announcements: Peter Simon, chair, opened the meeting at 9:10 a.m. Duane Jackson reported that Doug Voegeli has been activated to Kosovo for approximately 9 months; he will likely be working in the environmental health area—water supply and vectors. Harold Stanlick reported that one plumbing field consultant has been assigned pool plan review to assist with the backlog. In his place, Matt Jansen will conduct pool inspections. Sean O’Connor reported that he missed the last meeting in October due to the birth of his third daughter.

2. Public Input: None was given.

3. Progress Report for 10-16-03: MOTION by Carrico - Davis to accept report as distributed. Motion passed unanimously.

Discussion followed with regard to the material known as Rock Carpet and if Commerce had received an application for product approval. Also asked was if it known if the material was ultimately installed in the pool in question. Miller and Docken reported that the staff have not received an application. O’Connor believed that the material was not installed. Further discussion continued with regard to its long-term use, ease of cleaning and wearblity when installed in pools in other states.

4. Review of Hearing Comments, Agency Changes to Code Draft:
a) Hearing Comments. Docken noted that a copy of the summarized comments were made available to the Council. Staff have made changes to the rule draft in response; the official agency comments were not available at the time of the meeting.

b) Rule Revisions. Docken briefed the Council on the code revisions made to date with regard to meetings with various members of the Council public hearing comments and staff input.
-Fees. Fees were revised to note when a second and subsequent inspection fee would be required. Docken reported that this would allow up to 3 ‘free’ inspections when the submittal includes plan review fee for 3 pools as the inspection fee is included in the plan review fee. It was asked if the code was clear as to when a ‘pool’ is complete and ready for inspection.
-Definitions. Definition for open swim and piping were created. The definition for vanishing edge was amended for clarity.
- Submittal listing. The listing of items for submittal was revised and isometrics-elevations were now required.
-Pool temperature. Pool temperature and thermometers were discussed. The range of temperatures was changed to 90F. to 93F. to reflect comments received from DHFS.
-Appendix. Sketches for deck drains and obstructions for in-pool play features as well as ‘themed’ slides were created to clarify rule provisions and respond to public hearing comments.
-Sanitary facilities, distance and number provided. Rule provisions were revised to indicate that toilets were to be no farther than 300 feet from pool, but that dressing and shower areas have no maximum distance. Also, references to the IBC, chs. Comm 61-65, would be made in the Appendix to list how to determine patron load for deck areas and spectator sections, for example. Table 90.16 was also revised to provide a 25 perent reduction in toilets facilities for pools-water attractions at facilities having living units.
-Obstructions and barriers. Docken noted that s. Comm 90.18 was revised using same logic for slides as obstructions. Barriers were more clearly defined.
-Decks and deck drains. Discussions on obstructions resulted in providing a "usable" deck width or area.

c) Policies on the Commerce webpage (http:--commerce.wi.gov-). Docken noted that these policies were posted on the Commerce webpage for use up until this rule revision becomes effective. Clarifications were made for a number of items.

d) Handrail spacing in whirlpools. The code now lists a minimum width of 3 feet between the handrails. Examples were given for recent submittals especially for larger whirlpools where one main entry-exit point is provided.
