Make code change proposal - Form / Explanation of Process Safety and Buildings Division of the Wisconsin Department of Safety and Professional Services Archive of older code projects
Code titles changing: Administrative codes previously under the authority of the Department of Safety and Professional Services have been retitled to reflect the new authority of the Department of Safety and Professional Services. "Comm" codes are now "SPS" codes. Also, "300" has been added to all the current code numbers. For example, Comm 81 is now SPS 381. SPS 305 used to be Comm 5.

- Public hearing scheduled: There was a public hearing October 21, 2009, on an emergency rule that effects the recently adopted Comm 20 to 25 changes relating to the approved version of REScheck software used to show compliance with the Uniform Dwelling Code thermal envelope requirements. For the most part the proposed rule revisions are non-substantive in nature; correcting or providing consistent format, eliminating irrelevant dates, updating referenced national standards to current editions; clarifying registration obligations; and revising terminology to reflect statutory changes (2009 Wisconsin Act 291).

There are three substantive revisions:
- Establishing qualifying provisions for individuals applying to take the certification exam for automatic sprinkler fire sprinkler system testers. Applicants would be required to complete either level II NICET certification in the inspection and testing of water-based automatic fire sprinkler systems, or 1,500 hours of experience over 18 months as tester learner which would be a newly created credential.
- Establishing 12 hours of continuing education obligations for automatic fire sprinkler system testers for the renewal of the certifications on and after January 1, 2014.
- Reducing the continuing education obligations for utility contractor license renewal from 12 hours to 6 hours.

  Comm 40, Gas Systems, June 30, 2011, summary of adopted draft rules
- Comm 40 establishes minimum safety standards for design, construction, installation, operation, testing, inspection, repair and maintenance of liquefied petroleum gas systems, liquefied natural gas systems, compressed natural gas systems, gaseous hydrogen systems, and liquefied hydrogen systems – where these gas systems are used for fuel purposes, such as for heating appliances or engines.

- The rule changes primarily update this chapter to have it include newer editions of several referenced national standards from the National Fire Protection Association, and to make it consistent with current industry and regulatory practices. For example, the changes include more detailed requirements from a recent amendment to a national standard, for purging piping and equipment that use liquefied petroleum gas. Consent to incorporating the standards into the rules has been obtained from the attorney general.

- The changes also clarify and refine administrative elements, such as where and how the chapter applies, and where department-level plan approval and inspection is required, such as for vehicle-fuel dispensing systems.

  Comm 9, Movable Soccer Goals, May 13, 2011

Note on enforcement: People may file complaints with Commerce Department/Safety and Buildings Division online regarding soccer goals. Go to complaint form. Go to list of Safety and Buildings Division staff.

S&B staff will communicate to the goal owner named in the complaint their responsibility and obligation to secure the goal. S&B can provide some education information as to the risk posed by unsecured/anchored goal. The division's first objective is to correct the situation and change future behavior rather than seek punishment.

If circumstances warrant further action, division staff would issue orders to correct the situation. If left uncorrected, ultimately, the division would seek court action to gain compliance. Because the fine identified in the code language is a civil matter, rather than criminal, the institution of a fine would be at the discretion of the court. Any fine imposed would be assigned to the state school fund, pursuant to Article X of the state constitution.

Local enforcement could occur if municipalities enacted ordinances that reflect the statutory provisions of s. 167.21, Stats., and the administrative rules.

  Comm 81-84, Inventory and Maintenance of Private Onsite Wastewater Treatment Systems, July 15, 2011, Changes Summary

The proposed rules establish the requirements for the inventory and maintenance of POWTS as reflected in the statutory mandates of 2009 Wisconsin Act 392. The rules require the following:
- Governmental units shall conduct, complete and maintain an inventory of all POWTS located in their jurisdiction by October 1, 2013.
- Governmental units shall develop and implement a POWTS maintenance program by October 1, 2015.
In addition, the proposed rules include technical revisions to address code inconsistencies and new technologies.
