Federal accessibility regulations revised in July, 2010

The federal Department of Justice has adopted regulations revising the Department’s “Americans with Disabilities Act” regulations, including the 2010 Standards for Accessible Design.  The regulations go into effect in early 2011.  (Compliance with the 2010 Standards for Accessible Design is permitted after September 2011, but not required until 18 months after that date (after the date of publication).

The 2010 Standards will be the federally enforceable standard for most buildings, including institutional, commercial, recreational, transportation, and government facilities.  Building owners have responsibility to comply with federal accessibility requirements, as well as state building code requirements, including references to the International Building Code.

The 2010 standard references the Accessible Means of Egress section of the International Building Code.  The International Code Council has developed a matrix comparing the 2006 IBC, 2003 A117.1, 1991 ADAAG, and 2004 ADA/ABA Accessibility Guidelines.

The revised regulations amend Title III, Nondiscrimination on the Basis of Disability by Public Accommodations and Commercial Facilities 28 C.F.R. Part 36. Link to unofficial textLink to PDF Appendix B, Annalysis and commentary on 2010 ADA Stnadards for Accessibl Design.

Also amended is the Title II regulation, Nondiscrimination on the Basis of Disability in State and Local Government Services, 28 C.F.R. Part 35.  Link to unofficial text.
