What needs review?
All commercial, industrial, and other public buildings 25,000 cubic feet or larger. Also, review is needed for any size of school, high-hazard occupancy, and three-unit or larger residential building.

Petitions for Variance require submittal of form SBD-9890X. Petitions may be scheduled by using the online plan review scheduler, using option six.

Revisions to previously approved plans require submittal of form SBD-118. Revisions to previously approved plans may be scheduled by completing the form and faxing it to 877-840-9172 or emailing it to DspsSbPlanSchedule@wi.gov.

Structural Components require a submittal of form SBD-118. These are not pre-scheduled. Submit the components to the office specified in the building plan approval letter.

How do you schedule a review? Online request for Commercial Buildings Plan Review appointments, including fire protection systems. You need to allow pop-ups to use this application. It runs in a separate window. Note: This scheduling system does not support the submittal of revisions to existing approved plans. Revisions to previously approved plans require submittal of form SBD-118. Who does plan review? Plans are reviewed by Safety and Buildings Division Commercial Building Plan Reviewers located in five regional offices. Plans are also reviewed by delegated agent municipalities.

When is review done? Plans must be reviewed prior to beginning of construction. There is an optional "Permission to Start" available, which allows the owner to begin footings and foundation ahead of plan review.  Generally, plans for any building construction must be approved prior to review of associated HVAC or fire protection plans.

Where is review done? Review by S&B is done at five regional offices.

What is the timetable for the review process? By code, plan reviews must be completed within 15 business days of receipt of the application and all forms, fee, construction documents, and information required to complete the review. Check the status of a plan review.

Are inspections involved? Buildings may be inspected at various stages during construction. The inspections will be done by one of the division's commercial building inspectors, except when the project is located in a delegated agent municipality, where a local inspector will provide the inspection services. A list of the delegated municipalities is on the S&B WebSite. You also need local permits.

Codes? Comm 61-65 is the Wisconsin Commercial Building Code, which adopts portions of the International Building Code, International Energy Conservation Code, International Mechanical Code, International Fuel Gas Code, and ICC/ANSI A117.1-2003 Standard for Accessible Buildings. Commercial Building Petitions (See Comm 3, Petition for Variance Procedures code.) When there are unusual conditions or an alternative design and a proposed building cannot meet a section of the code, the owner has the option of submitting a "Petition for Variance" to propose an alternate method of achieving the code intent. Anything in an administrative code can be petitioned, except for those items that are part of a state statute. All petitions for variances to state administrative codes are reviewed by state staff, regardless of whether or not review of plans is done by local delegated municipal agents.

Petitions are not a means of avoiding the code, but rather a way to permit an alternate method of meeting the intent of the code. As part of the petition, the designer or owner must propose ways of providing an equivalent degree of safety. These alternate conditions, if approved, will be incorporated into the final petition.

Petitions for commercial buildings are reviewed by S&B's commercial buildings plan reviewers. Review is done at one of the five S&B full-service regional offices. The same reviewer normally does both a petition and an associated plan review, regardless of the sequence of submittal. After review, the draft petition, whether approved or denied, is subject to a final consideration by a Bureau of Integrated Services section chief.

A Petition for Variance can be submitted at any time; either prior to the plan submittal, during a plan review (if a problem with a code section is discovered during the review), or after review and approval of the plans (which might result, for example, from a change due to field conditions). Unlike a building plan review approval, there is no expiration date for an approved petition. It remains good for the life of the project, as long as conditions remain the same.

The petition needs to be submitted together with any relevant documentation, drawings, photographs, and other materials to be considered as a part of the petition. It is important to note that each petition is unique and is considered on its own merits. Therefore, all information that the reviewer would need to make a decision should be submitted. A position statement from the local building official is needed if they did the plan review or have related outstanding orders. In cases related to fire or life safety issues, the fire department position statement must be provided. (Overall, it is best to check with local fire department officials.)

Inspections are not part of a petition, but are done as part of the overall building process.

  Elevator Systems Plan Review

What needs review? The following elevator systems need plan review: New installations, covered remodels, and petitions for variance for passenger elevators, freight elevators, inclined elevators, limited-use limited-application (LULA) elevators, power sidewalk elevators, special purpose personnel elevators, Part V elevators, stage elevators, Type B material lifts, dumbwaiters, escalators, moving walks, vertical platform lifts, inclined platform lifts, and stairway chair lifts.   Fire Protection Systems Plan Review

What needs review? A January 1, 2012, code change increases the fire protection systems which need plan review in Wisconsin. Previous to that date, fire protection systems which required plan review were identified as being in specific building types or occupancies which were named in Table 361.30-3 of the Wisconsin Commercial Building Code. As of January 1, Wisconsin has changed to review of most fire suppression and fire alarm system projects. Table 361.30-3 has been repealed.

The trigger date for fire protection system plan review was based on the overall building plan submittal. For example, if a Group B occupancy building was submitted for review prior to December 31, 2011, then the fire suppression and fire alarm components were not required to be submitted. If the same building was submitted on January 1, 2012, the fire suppression and fire alarm components were required to be submitted for plan review.

The following municipalities are delegated agents of S&B to perform plan review and inspection of fire protection systems as prescribed under Comm 361.30(3): City of Appleton, City of Burlington, City of Madison, Village of McFarland, and City of Verona.

What is the review process? The review process depends of the type of system being reviewed. There are very specific requirements depending on the type of system submitted. You can contact a plan reviewer (see just above) to discuss the specifics.

Gas Systems Plan Review

What needs gas systems plan review? Liquid Petroleum Gas tank installation - 2000 gallon and larger, or 4000 gallon aggregate, per Comm 40.42; Compressed Natural Gas tank installation - any size installations, per Comm 40.61; Liquid Natural Gas tank installation - 2000 gallon and larger, per Comm 40.51; Gaseous Hydrogen Facilities - any size installations, per Comm 40.71; Liquefied Hydrogen Facilities - 2000 gallon and larger, or 4000 gallon aggregate, per Comm 40.81; Installation of Anhydrous Ammonia systems per Comm 43.10.   Plumbing plan review

What needs review? There are a variety of types of plumbing systems and individual fixtures that need plan review for public buildings, which are buildings with fixtures accessible to the public or employees. Tables 82.20-1 and -2 provide listings of those systems and fixtures. Link to index of S&B codes online. An important criteria is that when 16 or more plumbing fixtures are being newly installed or affected by alterations and additions plumbing plan review is probably needed. Can I start plumbing work before a required plan review is done?  No!

Do I need plan review for plumbing work I will do on my home or rental property?
- Any public building in which more than 16 fixtures are being installed or remodeled needs plan review.

- There are individual fixtures that at times need plan review. See "What needs review," above.

- A rental property that has three or more dwellings is subject to review.

- You must have a plumbing license to do plumbing in a rental dwelling. For a single-family dwelling in which you own and occupy, you do not need a license to do any plumbing installation, alterations, and repairs. However, a license is needed for plumbing work in a single-family rental dwelling that you own but do not occupy, or for any duplex or other multi-unit, even if you own the building and occupy one unit.

Must cross connection control devices have plan review? Review of ccc devices is required when the device is part of an overall plan review. Review of some individual devices is required in health care facilities. In other cases, registration of the devices is required. See Comm 82.20. Link to index of S&B codes online.

  Private Onsite Wastewater Treatment Systems (POWTS) plan review

What needs review? Plan review for a POWTS is needed whenever a new installation occurs, as well as when the replacement or addition of a POWTS treatment, holding, or dispersal component occurs. Petitions for Variance require submittal of form SBD-9890X.

Who does plan review? Plans are reviewed by S&B plan reviewers in one of five full-service S&B offices, or by delegated plan review agents (PDF file), or by the local governmental unit.

Plan which can only be submitted to S&B are: POWTS owned by the state; facilities owned by the state and served by POWTS; POWTS that will not completely utilize a component manual or approved plumbing products; designs which do not utilize an approved component manual (called "Individual Site Designs"), and experiments.

Plans which can be submitted to S&B or a designated agent are:
- POWTS that completely designed according to a component manual or are approved plumbing products. (Designs which do not utilize an approved component manual are called "Individual Site Designs.)
- Holding tanks that have a product approval and comply with a component manual.

Plan submissions which should go to the local governmental unit: POWTS that serve a single one- or two-family dwelling utilizing an approved component manual and gravity distribution to an in-ground distribution cell.

When is plan review done? Prior to construction or installation.

Is inspection involved? Counties have the primary responsibility to inspect POWTS, with the exception of state-owned projects.

What is the review process? Plans which meet a component manual are reviewed by a plan reviewer. "Individual Site Designs" are assigned to a plan reviewer, but the unique aspects of the design are considered by the division through a team review. Interpretive determinations and associated plans are reviewed by field staff.

  Swimming Pools (Public)

What needs review? The design for the construction, alteration, or reconstruction of a public swimming pool or public whirlpool shall be submitted to the Safety and Buildings Division for review in accordance with Comm 90.04. Public swimming pool" means a pool used for one or more purposes described in Comm 90.03(11) except for a pool serving fewer than three individual residential quarters such as homes or apartments. A public swimming pool includes a pool serving or installed for the state or any political subdivision of the state, including a school district; a pool serving or installed at a motel, hotel, resort, camp, club, association, housing development or school, or a religious, charitable or youth organization; a mobile pool; and a pool at an educational or rehabilitative institution. Included in the meaning of a "public swimming pool" are buildings, equipment and appurtenances, irrespective of whether or not a fee is charged for their use. A public swimming pool does not include a public swimming beach. In this subsection, "beach" means any designated body of water not contained in a pool structure, basin, chamber or tank and used for one or more purposes described in Comm 90.03(11), and the shore leading to that body of water.

Special plan review information: Because of federal requirements following the federal Virginia Graeme Baker Pool and Spa Safety Act, there is a need for all pool owners and operators in Wisconsin to see if they need to make immediate modifications to their pool. Is inspection involved? Inspection is required by Comm 90.04(6) for every pool. When a plan is approved, one copy is sent to the inspector in that area. A rough-in inspection is required when the piping system is installed and before the concrete is poured. The pool contractor, engineer or architect must contact the inspector via telephone to schedule the rough-in inspection. When the pool is complete, a final inspection is also required and is made when the architect or engineer responsible for the project contacts the inspector. The architect or engineer responsible for the project must provide the equipment required by the inspector. A pool may not be licensed before the inspector approves the construction. May I use the petition process to get around the intent of the code? No. Petitions are not a means of avoiding the code, but rather a way to permit an alternate method of meeting the intent of the code. As part of the petition, the designer or owner must propose ways of providing an equivalent degree of safety. These alternate conditions, if approved, will be incorporated into the final petition.

Can I justify a petition by saying I don't want to pay what it costs to comply with the code? No, that is not a significant factor. You must show you can provide equivalence with the code provisions you are petitioning.

Are there standard accepted petitions I can follow? No. Each petition is considered on its own basis because each circumstance is in some way unique.

Do I need a notary's signature on the petition application? Yes, per SPS 303.03(2)(a), such a signature is needed.

Must I complete the fire department position statement on the application? In cases related to fire protection or prevention issues, yes. Overall, it is best to check with local fire department officials.

Must I complete the Municipal Building Inspection recommendation section on the on the application? A position statement from the local building official is needed if they did the plan review or have related outstanding orders.

  Plumbing plan submittals shall include the following:
Two complete sets of plumbing plans and specifications (including materials and fixtures) (maximum of five).
Plans shall include:
1. Plot plan showing sanitary and/or storm sewer and water.
2. Floor plan showing horizontal drains, water distribution lines, and all fixtures and equipment to be installed.
3. 30/60 degrees isometric diagrams of the drain, vent and water distribution systems.
4. Complete water calculations in accord with s. Comm 82.40 (7).
5. Complete storm drain sizing calculations in accordance with s. Comm 82.36 (5).
6. Remodeling or additions shall include existing loads.
7. Water Quality Management Letter if required by s. Comm 82.20 (4)(c).
8. For storm water plans, submit appropriate architectural roof drainage plans, site grade run off plans and contour lines showing what is drained to the plumbing system.
9. For infiltration systems, submit Soil and Site Evaluation Form SBD-10793.
10. A Notice of Intent, form SBD-10376, must be filed with the Department if more than 1 acre is disturbed.
11. All plans must be properly signed as Comm 82.20 (4)(d). Plans involving more than one sheet must be BOUND into sets.
12. For water re-use submittals include information requested in the product approval.
