S&B Water Treatment Device Review Q&A

Q: I have heard that there were changes not long ago in the water treatment device review program, what were they?
A: Since 1985, the department had required that all residential water treatment devices be reviewed and approved prior to being sold or installed in Wisconsin.  As of January 1, 2010, the scope of the program expanded to also include certain categories of commercial water treatment devices.

Q: What are the new categories of commercial water treatment devices to be regulated?
A: The new categories of commercial water treatment devices are those that are installed on non-transient, non-community (NTNC), or transient, non-community (TNC), private water supplies for the purpose of mitigating a health effecting contaminant regulated under NR 809 of the Wis. Adm. Code and any pre-treatment devices required by the health effects devices (e.g. a water softener installed prior to a UV disinfection unit on a hard water supply).

Q: Are commercial devices installed only for aesthetic contaminants subject to the new rules?
A: No.

Q: Are commercial water treatment devices installed on municipal water supplies subject to the new rules?
A: No.

Q: What are some examples of a transient, non-community (TNC) water supply?
A: A TNC water supply system is a system that serves at least 25 people at least 60 days of the year; they do not serve the same 25 people over six months of the year. Examples of such systems include motels, restaurants, parks, taverns, churches and gas stations.

Q: What are some examples of a non-transient, non-community (NTNC) water supply?
A: A NTNC water supply system is a system that serves at least 25 of the same people over six months of the year. Examples of such systems include schools, daycares, factories and businesses.

Q: How do I apply for commercial water treatment devices approval?
A: The answer to this question is dependent upon if the water treatment device in question is a unique site specific design.  Inherent installation variables from installation site to installation site (e.g. length of piping, number of valves, type of valves, meters, etc.) alone do not constitute a unique, site specific design.  A unique, site specific, water treatment device is a device that has a design so unique that it is unlikely to be repeated elsewhere in the State of Wisconsin, or on an extremely limited basis.

Site specific designs are reviewed as plumbing plans; the balance of commercial water treatment devices are reviewed using the traditional process.

Q: Why was this change made?
A: Because this work was formerly being done by the Wisconsin Department of Natural Resources (WDNR), the net change is minimal. The work formerly being done by the WDNR is simply being transferred to the Wisconsin Department of Safety and Professional Services. The only difference is that DSPS will be charging a fee for the service it provides.  The applicable fees are displayed on the pertinent application forms.
