On February 14, 2001, Dane County Judge Gerald Nichol dismissed the Comm 83 lawsuit that challenged the Department of Safety and Professional Services's authority to process major POWTS Code changes.
Although this appears to mark the end of that chapter of the Comm 83 code implementation, newspaper reports indicate that the plaintiffs are exploring the possibility of appealing the decision. Meanwhile, work has begun on a "fix-up" Comm 83 code package. Safety and Buildings Division staff recognized that, given the significant nature of the revisions that went into effect last July, there would be "glitches" that would be identified once everyone began using the code on a day-to-day basis. S&B has kept a list of issues that were brought to our attention. Recently, S&B appointed an advisory POWTS Code Council to assist in developing the fix-up package. The group met for the first time on February 20, 2001. At this meeting the list of possible code changes was expanded. The council members decided to form several subgroups that will meet to discuss issues that were placed into four broad categories identified as: Administration, Design, Maintenance, and Soil. Future articles in the WPCR will report on the activities and progress of the council. The goal is to have proposed revisions to the code ready for public hearing later this year.   2. The Safety and Buildings Division Bureau of Integrated Services has a new supervisor, Josh Schultz. Schultz, who has a background as an owner and supervisor in the construction industry, will oversee the Madison S&B Plan Entry Unit, jschultz@commerce.state.wi.us.

Problem: In the past, programs in the Safety and Buildings Division, such as plumbing, electrical or building inspection, have had a range of standards used to consider courses for continuing education credit for credential holders.
This caused confusion and controversy for customers who wish to provide courses for more than one program or for those requesting that a course be approved for several credential categories within a program. Solution: Uniform standards for course approvals. The division decided to work as a unit to develop standards that will be used by each program to consider applications for approval of classes for continuing education credit for credential holders. Intent: Continuing education credit should enhance the skills, knowledge, and ability necessary to perform the function of the license or certification. The S&B course approval standards now are: -A course may teach codes and national technical standards specific to the licenses or certifications. -A course may teach codes and national technical standards related to the job descriptions for the licenses or certifications (e.g., ADA and fire stop penetration for plumbers). -A course may teach codes and national technical standards related to an industry. -A technical course may focus on work included under a license or certification. -A technical course may relate to work performed under a license or certification. (An example would be lighting courses for electricians.) -A technical course may concern new products and practices related to a license or certification. - A trade show may be related to the industry of a license and certification (max. one hour credit). -A course may relate to the training or supervisory responsibilities that are necessary or required under a license or certification. -A course may teach math skills related to the license or certification exam or job description for the license or certification. This is not basic math, but rather calculations and math needed to perform under a license or certification. -A course may teach use of specific technical software used to design or perform responsibilities or activities under a license or certification. -Service on a division advisory code council or committee. -Attending trade safety courses relating to federal Occupational Safety and Health Administration obligations and requirements under CFR Part 1926 (Construction Site Safety). -American Red Cross first aid training or equivalent. S&B can accept evaluated correspondence courses for continuing education credit.
Internet courses can be approved. Courses are approved for a five-year period. Note that a condition of a course approval may be that course content will be revised if a code change that would impact the nature or scope of the course occurs during that period. Credit will be given for attending the same course twice. The value of attending the same course with a different audience which asks different questions, thus leading the discussion down different paths, is recognized. Course approval is required prior to presentation of the course. No credit will be given for attending a course prior to course approval except via the petition for variance process.   9. Designated County Agents for POWTS Plan Review and Categories of Review - Feb.01, 2001
Comm 83, the POWTS Code, contains a provision for counties to request designated plan review agent status from the Safety and Buildings Division. S&B has contacted those counties that were plan review agents under the previous code and asked them if they were interested in keeping and/or expanding their plan review authority. The division also contacted all the other counties to remind them of the designated agent code provision and to ask them to consider requesting the designation.
17 counties have been approved as designated plan review agents. See below. These counties have requested review authority for some or all of the types of plans identified in Comm Table 83.22-2. The category of plan review requested varies from county to county. If you work in one of these counties, please contact them for more information about the types of plans they are approved to review and to learn what types of POWTS plan review procedures they may have implemented. More counties may receive designated agent approval prior to the start of the next construction season. Three more Private Onsite Wastewater Treatment System component manuals are now available for designers to use. Nine component manuals were originally released along with the revised Comm 83, POWTS Code, in July 2000. The three latest manuals are "Versions 2.0" of earlier released manuals. The new manuals are not considered replacements of the earlier manuals; S&B does not have the code authority to issue "replacements." The new versions do include corrections and updates to the earlier versions.
The newly released manuals include:
In-ground Soil Absorption Component Manual, Version 2.0, SBD-10705-P (N.01/01);
Mound Component Manual, Version 2.0, SBD- 10691-P (N.01/01);
Pressure Distribution Component Manual, Version 2.0, (N.01/01).
Now that more than one component manual exists for in-ground systems, mounds, and pressurized systems, it's more important than ever to ensure that the title, SBD-number, and revision date of each component manual that the design is based upon, are listed on the title page of the plans. Without this information, plan reviewers and inspectors will have no way of telling which of set of standards apply to the design, causing possible delays in getting the plans approved and/or delays at the job site. Each one of the currently approved 12 component manuals reflects a recognized POWTS component design method under Comm 83.60 and Comm 84.10(3). When a designer chooses to submit a plan under one of the manuals, each manual must be followed in its entirety. Some designers have fallen to the temptation to "cherry pick" desirable items from multiple component manuals; the resulting mixed design will not receive plan approval. Designs that do not conform to a particular manual must be submitted with sufficient documentation to support the design and with fees appropriate for a non-manual individual site design.
