Offenses that May Result in Refusal, Bar, or Termination of Licensure

Generally, the department or licensing board may refuse to license an initial applicant or bar or terminate from licensure a renewal applicant who was convicted of any felony, misdemeanor, or other offense, including ordinances, the circumstances of which substantially relate to the circumstances of the particular licensed activity.  Wis. Stat. § 111.335(3).  The following are alternative or additional standards set out in statute for potential denial of licensure related to specific professions:

Aesthetician

Subject to the general standard stated above, any conviction of a felony committed while engaged in the practice of cosmetology.

Athlete Agent

Conviction of a crime that is substantially related to the profession, if that crime would be a felony if committed in Wisconsin.

Barber

Subject to the general standard stated above, any conviction of a felony committed while engaged in the practice of barbering.

Behavior Analyst

Conviction of an offense under s. 940.22, 940.225, 940.302 (2) (a) 1. b., 944.06, 944.15, 944.17, 944.30 (1m), 944.31, 944.32, 944.33, 944.34, 948.02, 948.025, 948.051, 948.06, 948.07, 948.075, 948.08, 948.081, 948.09, 948.095, 948.10, 948.11, or 948.12 of the Wisconsin Statutes.

Body Piercer

No conviction bar.

Cosmetologist

Subject to the general standard stated above, any conviction of a felony committed while engaged in the practice of cosmetology.

Crematory Authority

Conviction of an offense that is substantially related to the profession, which was committed while registered as a crematory authority.

Dwelling Contractor

Conviction of a crime related to the construction of a dwelling.

Electrologist

Subject to the general standard stated above, any conviction of a felony committed while engaged in the practice of cosmetology.

Interior Designer

Conviction of a felony that is substantially related to the profession.

Juvenile Martial Arts Instructor

Conviction of an offense under section 940.01 of the Wisconsin Statutes or a violation of the law of another state or the United States that would be a violation of section 940.01 if committed in Wisconsin.

Licensed Midwives

Conviction of an offense under sections 940.22, 940.225, 944.06, 944.15, 944.17, 944.30 (1m), 944.31, 944.32, 944.33, 944.34, 948.02, 948.025, 948.051, 948.06, 948.07, 948.075, 948.08, 948.081, 948.09, 948.095, 948.10, 948.11, or 948.12 of the Wisconsin Statutes or under section  940.302 (2) if section 940.302 (2) (a) 1. b. of the Wisconsin Statutes applies.

Manicurist

Subject to the general standard stated above, any conviction of a felony committed while engaged in the practice of cosmetology.

Massage Therapists and Bodywork Therapists

Conviction of an offense under sections 940.22, 940.225, 944.15, 944.17, 944.30 (1m), 944.31, 944.32, 944.33, 944.34, 948.02, 948.025, 948.08, 948.081, 948.085, 948.09, 948.095, or 948.10 of the Wisconsin Statutes, or any offense under federal law or a law of any other state that is comparable to the listed offenses.

Nursing

Offenses that show the applicant is unfit to practice nursing by reason of abuse of alcohol or drugs.

Nursing (Compact)

Convicted or found guilty, or has entered into an agreed disposition, of a felony offense under applicable state or federal criminal law, or convicted or found guilty, or has entered into an agreed disposition, of a misdemeanor offense related to the practice of nursing as determined on a case-by-case basis.

Physician (Compact)

Any conviction, adjudication, deferred adjudication, community supervision, or deferred disposition for any offense.

Private Detectives

Any felony conviction.

Private Investigators

Any felony conviction.

Private Security Permit

Any felony conviction.

Private Security Personnel

Any felony conviction.

Real Estate Broker (Initial Applicant)

Any felony conviction, if it is within three years of the date on which the confinement portion of the sentence is completed. 

Real Estate Salesperson (Initial Applicant)

Any felony conviction, if it is within three years of the date on which the confinement portion of the sentence is completed. 

Tanning Faciility

No conviction bar.

Tattooist

No conviction bar.

Unarmed Combat Sports

Any violations of chapter 444 of the Wisconsin Statutes or chapter SPS 192 of the Wisconsin Administrative Code.

Wholesale Distributor (Pharmacy)

Conviction of any felony or violation of any federal, state, or local law relating to wholesale or retail prescription drug distribution or distribution of a controlled substance.
